Terms of Service

By using Preserve Forever, you agree to these Terms of Service. You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent. If you do not agree to these Terms, do not use the service.
You may use Preserve Forever to store personal photos and media. You may NOT upload, store, or share: child sexual abuse material (CSAM), non-consensual intimate imagery (NCII), content that infringes on third-party intellectual property, malware, or any content illegal in your jurisdiction. Violations result in immediate account termination and mandatory reporting to NCMEC and relevant law enforcement authorities.
Every uploaded image is automatically scanned using two complementary systems: (1) Microsoft PhotoDNA, which computes a perceptual hash of each image and compares it against a database of known child sexual abuse material (CSAM) maintained by the National Center for Missing & Exploited Children (NCMEC) and international law enforcement agencies; and (2) AWS Rekognition, which uses machine-learning to detect novel illegal content not yet in known-hash databases. Only the hash — not the image itself — is submitted to Microsoft for matching; images are never transmitted to third parties for scanning purposes. If a match or detection occurs, we are required by law (18 U.S.C. § 2258A) to report it to NCMEC via the CyberTipline. The report includes the flagged content, account identifiers, IP address at time of upload, and GPS metadata if present. The account is immediately suspended and the content is quarantined and preserved for law enforcement in accordance with 18 U.S.C. § 2258B.
We reserve the right to terminate any account that violates these Terms, with or without notice. Accounts with confirmed CSAM/NCII will be terminated immediately and reported to NCMEC and relevant law enforcement.
Plans are billed monthly via Stripe. Cancel anytime — your access continues until the end of the billing period. We do not offer refunds for partial months. We reserve the right to change pricing with 30 days notice. If your storage usage exceeds the cap of a lower plan, you will be asked to free up space (delete or restore from the Archive) before downgrading; we will not silently delete your content. The Basic (free) plan does not include the Archive — you may need to remove archived content before downgrading to Basic. EU/UK consumers: by subscribing to a paid plan you expressly request immediate access to the service and acknowledge that your 14-day right of withdrawal under the Consumer Rights Directive (EU 2011/83/EU) and the UK Consumer Contracts Regulations 2013 is waived once the digital service has been fully performed.
Photos are encrypted in transit using TLS for all uploads, downloads, and API traffic. Photos at rest in cold storage (the Archive) are additionally encrypted at the application layer with AES-256-GCM using a per-user key. These keys are wrapped with a master key under our control so we can serve restore requests and run the legally-required CSAM scanning. This is close to, but not the same as, end-to-end encryption — a true end-to-end model would require keys held only by you, which would prevent server-side restore and the moderation we are required by law to perform. We aim for 99.9% uptime but do not guarantee it. We are not liable for losses resulting from service outages. Archive retrieval times (typically 3–5 hours) are estimates only and may vary based on infrastructure conditions.
Preserve Forever is provided "as is." We are not liable for any indirect, incidental, or consequential damages. Our maximum liability is limited to the amount you paid in the 3 months preceding the claim.
We may update these Terms from time to time. Material changes will be communicated via email and a notice on the dashboard. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
